• Promptly notify us of any unauthorised access

4. Credits and Payments

4.1 Credit System

The Service operates on a credit-based system. Credits are used to pay for AI model usage and platform features. Different AI models have different credit costs based on their pricing.

4.2 Credit Purchases

• Credits are purchased in advance and are non-refundable
• Credits do not expire
• Payments are processed securely via Stripe
• All prices are displayed in Australian Dollars (AUD) unless otherwise specified

4.3 Pricing Changes

We reserve the right to modify pricing at any time. Changes will not affect credits already purchased. We will provide reasonable notice of any significant pricing changes.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Generate, distribute, or facilitate harmful, abusive, or illegal content
• Attempt to circumvent security measures or access controls
• Interfere with or disrupt the Service or its infrastructure
• Use automated means to access the Service in an abusive manner
• Resell or redistribute the Service without authorisation
• Use the Service to build a competing product

6. Intellectual Property

6.1 Our Property

The Service, including its design, features, and content, is owned by Koota and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

6.2 Your Content

You retain ownership of content you create using the Service. By using the Service, you grant us a limited licence to process your content as necessary to provide the Service.

The Service integrates with third-party AI providers (including OpenAI, Anthropic, Google, and others). Your use of these services through our platform is also subject to their respective terms of service and acceptable use policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The Service will be uninterrupted or error-free
• AI-generated outputs will be accurate, complete, or suitable for your purposes
• The Service will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOOTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Koota, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
